Procedural indemnity

The Council of State can order the losing applicant or defendant to grant a procedural indemnity to the party in whose favour the Council decides. This indemnity is a fixed compensation for the lawyer’s costs and fees of the latter party. For that purpose a basic amount has been established that may be increased or decreased within certain limits, depending on the circumstances of the case. This indemnity cannot be granted to or imposed upon an intervener.
